NOVA PRIVACY POLICY

This Privacy Policy explains how xobytes.com and nove (“Nova,” “we,” “us,” or “our”) collects, uses, stores, shares, and protects information when you use Nova, including our website, software, artificial intelligence features, games, LIVE experiences, TikTok integrations, and related services (collectively, the “Service”).

This Privacy Policy also explains the choices and rights available to you regarding your information.

By using the Service, you acknowledge the practices described in this Privacy Policy.

1. ABOUT NOVA

Nova is an interactive artificial intelligence character and virtual creator.

Depending on the features enabled, Nova may communicate with viewers, participate in TikTok LIVE experiences, respond to comments and supported events, play games, maintain viewer progress, recognize returning participants, provide achievements and virtual rewards, create content, and interact through an embodied virtual character.

Nova is an independent service and is not owned, operated, sponsored, endorsed, or controlled by TikTok.

TikTok separately controls information processed through TikTok and is governed by TikTok’s own privacy policies and terms.

2. INFORMATION WE MAY COLLECT

The information Nova receives depends on how you interact with the Service and which features you authorize.

We seek to collect and use only information reasonably necessary to provide the features being used.

A. Information Received From TikTok

If you connect to Nova through an authorized TikTok integration, we may receive information permitted by TikTok and authorized by you.

Depending on the approved TikTok products, scopes, and features in use, this may include:

  • TikTok user identifier;
  • display name;
  • username or profile name;
  • profile image;
  • basic profile information;
  • authorization information;
  • information necessary to identify an authorized TikTok account;
  • permitted content information;
  • permitted engagement information; and
  • other information specifically authorized through an approved TikTok permission or scope.

We do not receive access to all information in your TikTok account merely because you interact with Nova.

Access depends on the permissions approved by TikTok and, where applicable, authorized by the TikTok user.

B. LIVE and Viewer Interaction Information

When Nova is participating in a supported LIVE experience, the Service may process information associated with interactions that are made available to the Service.

Depending on the integration and features available, this may include:

  • display names;
  • usernames or platform identifiers;
  • comments;
  • questions;
  • game answers;
  • votes;
  • participation events;
  • supported engagement events;
  • permitted gift-event information;
  • timestamps;
  • scores;
  • achievements;
  • viewer participation history; and
  • other information necessary to operate the LIVE experience.

Nova may use this information to respond to viewers and maintain the interactive experience.

C. Game and Progress Information

When you participate in Nova games or interactive experiences, we may maintain information such as:

  • games played;
  • scores;
  • wins and losses;
  • streaks;
  • trivia performance;
  • achievements;
  • titles;
  • XP;
  • Nova Coins;
  • rankings;
  • participation history;
  • competition records; and
  • related game statistics.

This allows progress and recognition to persist between supported sessions.

D. Nova Memory and Relationship Information

Nova may maintain limited memory designed to provide continuity with returning participants.

Depending on your interactions, memory may include information such as:

  • previous interactions with Nova;
  • games you have played;
  • achievements earned;
  • previous competition results;
  • things you voluntarily tell Nova;
  • preferences voluntarily expressed during interactions;
  • recurring conversation topics; and
  • other information useful for maintaining a continuing interactive relationship.

Nova’s memory systems are designed for entertainment and continuity.

We may limit, correct, summarize, or remove memory where appropriate for privacy, safety, data minimization, technical maintenance, or legal compliance.

E. Gift and Engagement Information

If TikTok or another supported platform provides permitted information indicating that a user sent a gift or generated another engagement event, Nova may process information such as:

  • sender display name or identifier;
  • gift type;
  • quantity;
  • time of the event; and
  • related interaction information.

Nova may use this information to:

  • acknowledge and thank the sender;
  • perform a character reaction;
  • display a permitted celebration;
  • activate a permitted entertainment feature;
  • update a community goal; or
  • remember a meaningful interaction.

We do not treat TikTok Coins, Gifts, Diamonds, or similar TikTok Virtual Items as Nova currency.

Nova Coins are separate internal entertainment points with no cash value.

F. Content You Provide

You may voluntarily provide information through:

  • prompts;
  • comments;
  • questions;
  • messages;
  • images;
  • audio;
  • video;
  • feedback;
  • game submissions;
  • uploaded content; or
  • other interactions.

We process that information as necessary to provide the requested feature.

Please avoid voluntarily providing highly sensitive personal information when it is not necessary.

G. Technical Information

When you use our website, application, or related services, we may automatically receive limited technical information such as:

  • device or browser type;
  • operating system;
  • application version;
  • IP address;
  • approximate region derived from network information;
  • error logs;
  • diagnostic information;
  • timestamps;
  • security events; and
  • service-performance information.

We may use this information to operate, troubleshoot, secure, and improve the Service.

H. Information From Connected Services

If Nova uses another service at your request or through an enabled integration, we may process information necessary to complete that function.

Those services may also process information under their own privacy policies.

3. HOW WE USE INFORMATION

We may use information to:

  • provide Nova’s interactive features;
  • authenticate authorized accounts;
  • operate approved TikTok integrations;
  • recognize returning participants;
  • respond to comments and questions;
  • conduct games and challenges;
  • calculate scores and determine winners;
  • provide XP, Nova Coins, achievements, titles, or rankings;
  • maintain viewer progress;
  • remember relevant prior interactions;
  • personalize Nova’s permitted interactions;
  • acknowledge supported gifts and engagement events;
  • operate LIVE experiences;
  • moderate abusive or unsafe interactions;
  • create and improve content;
  • troubleshoot software;
  • detect fraud, cheating, abuse, or security threats;
  • maintain service reliability;
  • understand how features are used;
  • improve Nova’s performance and user experience;
  • comply with legal obligations; and
  • enforce our Terms of Service.

We do not use TikTok user data for purposes unrelated to the functionality for which it was obtained unless permitted by applicable law, TikTok requirements, and appropriate user authorization.

4. TIKTOK AUTHORIZATION AND PERMISSIONS

Where Nova uses TikTok authorization, users may be asked by TikTok to approve specific permissions.

Nova will seek to request only permissions reasonably necessary for the features being provided.

A TikTok user may choose whether to authorize requested permissions and may revoke authorization through TikTok where TikTok provides that functionality.

If authorization is denied or revoked, some Nova features may no longer function for that TikTok account.

Revoking TikTok authorization does not necessarily delete information previously lawfully stored by Nova.

You may separately request deletion as described in the Your Privacy Choices and Rights section below.

5. HOW WE HANDLE TIKTOK DATA

We recognize that TikTok user data belongs to TikTok users and must be handled responsibly.

We seek to:

  • access only TikTok data permitted through approved integrations;
  • use TikTok data only for disclosed and permitted purposes;
  • protect TikTok data from unauthorized access;
  • limit internal access where reasonably appropriate;
  • avoid unnecessary collection;
  • avoid unnecessary retention;
  • respect user authorization choices;
  • comply with applicable TikTok developer requirements; and
  • delete or discontinue use of TikTok data where required.

We do not intentionally sell personally identifiable TikTok user data.

We do not provide personally identifiable TikTok user data to unrelated third parties for their independent advertising or marketing purposes.

6. HOW INFORMATION MAY BE SHARED

We may share information in the limited circumstances described below.

A. Service Providers

We may use companies or technology providers that perform services on our behalf, such as:

  • hosting;
  • cloud infrastructure;
  • databases;
  • security;
  • artificial intelligence processing;
  • content delivery;
  • analytics;
  • error monitoring;
  • email or support systems; and
  • other technical infrastructure.

These providers may process information only as reasonably necessary to provide their services to us and subject to applicable contractual or legal safeguards.

B. Platforms You Choose to Use

If you use Nova through TikTok or another third-party platform, information may be exchanged with that platform as required to provide the requested integration.

The third-party platform independently controls information it collects through its own service.

C. Legal Requirements

We may disclose information if we reasonably believe disclosure is necessary to:

  • comply with applicable law;
  • respond to a lawful request;
  • comply with a valid court order;
  • enforce our legal rights;
  • investigate fraud or abuse;
  • protect the security of the Service;
  • protect users or other people from harm; or
  • respond to an emergency where legally permitted.

D. Business Transfers

If the Service or company is involved in a merger, acquisition, restructuring, sale, or transfer of assets, information may be transferred as part of that transaction subject to applicable privacy requirements.

E. With Your Direction or Consent

We may share information when you direct us to do so or otherwise give appropriate consent.

7. INFORMATION WE DO NOT INTEND TO SELL

We do not intend to sell TikTok user data.

We do not intend to sell personally identifiable information collected through Nova to data brokers.

If our practices materially change, we will update this Privacy Policy and provide any legally required choices or notices before applying the new practice.

8. AI PROCESSING

Nova uses artificial intelligence systems to provide some features.

Information you submit may be processed by AI systems to:

  • understand your request;
  • generate responses;
  • conduct conversations;
  • interpret game or LIVE interactions;
  • personalize permitted interactions;
  • assist with content creation;
  • analyze information; or
  • provide other Nova functionality.

Some AI functionality may rely on third-party AI service providers.

When third-party AI services are used, we seek to provide only information reasonably necessary for the relevant function.

Nova may also perform some processing locally without transmitting information to an external AI provider.

9. COMPUTER VISION AND AUDIO FEATURES

Certain Nova features may use computer vision, image processing, speech recognition, or audio processing.

Depending on the specific feature, these technologies may be used to:

  • detect objects;
  • interpret a scene;
  • understand movement;
  • evaluate Nova’s virtual body;
  • recognize permitted visual activity;
  • transcribe speech;
  • identify interaction events; or
  • operate interactive experiences.

The availability and use of these features may vary.

We do not intend to use these technologies to conduct unlawful surveillance.

Where biometric or similarly sensitive processing would require separate consent or disclosure under applicable law, we will obtain or provide the required authorization before enabling that functionality.

10. DATA RETENTION

We retain information only for as long as reasonably necessary for the purpose for which it was collected, unless a longer period is required or permitted by law.

Retention periods may differ depending on the information.

For example:

Temporary technical information may be retained for a limited period for troubleshooting, security, or reliability.

Viewer progress and game history may be retained while the relevant Nova profile remains active so that achievements and progress persist.

Nova memory information may be retained to provide continuing interactions but may be summarized, corrected, or removed over time.

Security and legal records may be retained for periods reasonably necessary to protect the Service or satisfy legal obligations.

TikTok authorization information may be retained only while reasonably necessary to maintain an authorized integration and subject to applicable TikTok requirements.

When information is no longer reasonably necessary, we may delete, anonymize, or aggregate it.

Backups may retain deleted information for a limited additional period before being overwritten.

11. DATA DELETION

You may request deletion of personal information associated with you where applicable.

A deletion request may include information such as:

  • Nova viewer profile;
  • saved game history;
  • XP or Nova Coin records;
  • achievements;
  • stored Nova memories associated with you;
  • account-linking information; and
  • other personal information we maintain about you.

Some information may be retained when reasonably necessary to:

  • comply with law;
  • prevent fraud;
  • maintain security;
  • resolve disputes;
  • demonstrate compliance;
  • enforce agreements; or
  • protect the rights of users or the Service.

To request deletion, contact us using the information in the Contact Us section.

We may request reasonable information necessary to verify that the request relates to you.

12. DISCONNECTING TIKTOK

If you have authorized Nova through TikTok, you may be able to revoke Nova’s access using TikTok’s account or authorization controls.

After access is revoked:

  • Nova will stop using that authorization for future TikTok API access;
  • features depending on the revoked authorization may stop working; and
  • existing information retained by Nova remains subject to this Privacy Policy and applicable deletion rights.

You may contact us separately if you want stored Nova information deleted.

13. YOUR PRIVACY CHOICES AND RIGHTS

Depending on where you live, you may have rights concerning personal information, including rights to:

  • request access;
  • request correction;
  • request deletion;
  • obtain information about processing;
  • request a copy of certain information;
  • object to certain processing;
  • restrict certain processing;
  • withdraw consent where processing relies on consent; and
  • appeal certain privacy decisions where applicable.

We will respond to valid privacy requests as required by applicable law.

You may also contact us if you believe Nova has stored incorrect information about you.

14. CHILDREN AND YOUNG USERS

Nova is not intended to circumvent TikTok’s age requirements or any legally required protections for children.

Users interacting through TikTok must satisfy TikTok’s applicable age requirements.

We do not knowingly collect personal information from children in violation of applicable law.

If we learn that personal information was collected from a child when collection was prohibited, we will take reasonable steps to delete or otherwise handle that information as required.

Parents or legal guardians who believe a child has provided personal information improperly may contact us.

15. SENSITIVE PERSONAL INFORMATION

Please do not provide Nova with sensitive personal information unless it is reasonably necessary for a supported feature and appropriate safeguards have been provided.

Sensitive information may include, depending on applicable law:

  • government identification numbers;
  • financial account credentials;
  • precise location;
  • medical records;
  • passwords;
  • private authentication credentials;
  • highly sensitive biometric data; or
  • other information legally classified as sensitive.

Nova should never be used to request or expose another person’s confidential credentials.

16. SECURITY

We use reasonable administrative, technical, and organizational safeguards designed to protect information against:

  • unauthorized access;
  • loss;
  • misuse;
  • alteration;
  • disclosure; and
  • destruction.

These measures may include, where appropriate:

  • access controls;
  • secure authentication;
  • encrypted network communication;
  • software updates;
  • logging;
  • restricted credentials;
  • monitoring;
  • backups; and
  • security reviews.

No system can guarantee absolute security.

If we become aware of a security incident affecting personal information, we will respond in accordance with applicable law and platform requirements.

Our Service and service providers may process information in the United States or other jurisdictions.

Where applicable law requires safeguards for international transfers of personal information, we will use appropriate mechanisms.

20. PUBLIC LIVE CONTENT

TikTok LIVE and other social-platform interactions may be public.

Information you voluntarily post publicly, including comments, usernames, game answers, and other LIVE interactions, may be visible to:

  • Nova;
  • the broadcaster;
  • other viewers;
  • TikTok;
  • and potentially the broader public.

Please consider this before sharing personal information during a public LIVE.

Nova’s processing of public interaction data does not change the public nature of information you choose to post on TikTok.

21. LEADERBOARDS AND PUBLIC RECOGNITION

Certain Nova features may display public-facing information such as:

  • usernames or display names;
  • scores;
  • rankings;
  • achievements;
  • titles;
  • game wins; and
  • competition results.

These features are intended to support interactive entertainment.

Where practical, public recognition will use platform display names, usernames, avatars, or other information already associated with the public interaction rather than unrelated private information.

22. AGGREGATED AND DE-IDENTIFIED INFORMATION

We may create aggregated or de-identified information that does not reasonably identify an individual.

We may use this information to:

  • understand Service usage;
  • improve features;
  • analyze game performance;
  • improve Nova’s interactions;
  • measure reliability; and
  • perform general analytics.

We will not intentionally attempt to re-identify properly de-identified information except where necessary to test privacy safeguards or where otherwise permitted by law.

23. THIRD-PARTY LINKS AND SERVICES

The Service may link to or interact with third-party services.

Examples may include:

  • TikTok;
  • artificial intelligence providers;
  • streaming services;
  • hosting providers;
  • media services; and
  • other external resources.

We do not control the independent privacy practices of those services.

Please review their privacy policies before providing information directly to them.

24. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy to reflect:

  • changes to Nova;
  • new features;
  • changes to TikTok integration;
  • legal requirements;
  • platform-policy requirements;
  • security improvements; or
  • changes to our information practices.

When we make changes, we will update the effective date.

If required by law, we will provide additional notice or obtain consent before materially different processing begins.
