3. Estimates, Pricing, and Hourly Work
Public prices shown on this website are starting prices and general estimates. Final pricing depends on project scope, complexity, features, integrations, design needs, timeline, third-party costs, and ongoing support needs.
Custom development, updates, fixes, consulting, troubleshooting, website management, plugin edits, theme changes, automation, API work, and software improvements may be billed at $75 per hour unless otherwise agreed in writing.
4. Payments
Payment terms will be stated in the applicable invoice, estimate, proposal, or project agreement. Work may require a deposit, milestone payment, recurring payment, or payment before delivery depending on the project.
Xobytes may pause work, delay delivery, or withhold files, access, code, deployments, or deliverables when required payments are not received.
5. Client Responsibilities
Clients are responsible for providing accurate information, timely feedback, required access, content, approvals, accounts, files, brand assets, legal pages, and third-party service credentials needed to complete the project.
Delays in client feedback, access, approvals, or required materials may delay the project timeline.
6. Changes To Scope
New features, design changes, extra pages, additional integrations, revisions beyond the agreed scope, emergency changes, or changes requested after approval may require additional time and cost.
7. Third-Party Services
Projects may use third-party services such as WordPress, Shopify, hosting providers, payment processors, email services, analytics tools, AI APIs, plugins, themes, software libraries, and other platforms.
Xobytes is not responsible for third-party outages, pricing changes, API changes, security issues, discontinued services, account restrictions, platform limitations, or third-party policy changes.
8. AI Features and Generated Content
Some projects may include AI tools, AI-generated content, AI recommendations, automation, or agentic software features. AI output may be inaccurate, incomplete, or require human review.
Clients are responsible for reviewing AI-generated text, images, recommendations, code, legal language, business decisions, marketing content, and any automated output before relying on it.
9. SEO, Traffic, Revenue, and Results
Xobytes may build SEO tools, websites, automations, analytics systems, and software designed to support growth. However, Xobytes does not guarantee rankings, traffic, sales, revenue, leads, conversions, app approval, platform acceptance, or business results.
10. Intellectual Property
Unless otherwise agreed in writing, clients own final custom deliverables created specifically for them after full payment is received. Xobytes may retain rights to pre-existing code, frameworks, reusable components, tools, libraries, internal systems, concepts, workflows, and general know-how used to create deliverables.
Clients are responsible for ensuring they have rights to any content, images, logos, fonts, files, software, data, trademarks, or third-party materials they provide.
11. Portfolio Use
Unless restricted by written agreement, Xobytes may reference completed work, project type, screenshots, general descriptions, and non-confidential results in portfolios, case studies, marketing materials, or website content.
12. Security and Backups
Xobytes may take reasonable steps to build secure systems, but no website, plugin, app, API, hosting account, AI system, or software platform can be guaranteed completely secure or error-free.
Clients are responsible for maintaining backups, account security, passwords, access control, hosting plans, and ongoing maintenance unless Xobytes is specifically hired to provide those services.
13. Limitation of Liability
To the fullest extent allowed by law, Xobytes will not be liable for indirect, incidental, special, consequential, punitive, lost-profit, lost-revenue, lost-data, business interruption, or similar damages arising from use of this website or services.
14. No Professional Legal, Financial, or Medical Advice
Xobytes provides software, website, automation, and development services. Content, tools, AI output, templates, or software provided by Xobytes should not be treated as legal, financial, medical, tax, or professional advice.
15. Termination
Xobytes may stop providing services if a client fails to pay, violates these terms, abuses communication channels, creates security concerns, requests unlawful work, or fails to provide required access or cooperation.
